Shamim Modi being victimized by police-politician nexus in Madhya Pradesh

New Delhi: In a clear case of growing hostility against human rights activists and those voicing for the voiceless, besides rising systematic discrimination against minorities, in BJP-ruled states, young woman social activist Shamim Modi has become the latest victim of the police-politician nexus in Madhya Pradesh.

Shamim Modi was arrested on 10 February in some old cases. She is presently languishing in Hoshangabad jail. One is a kidnapping case. The police alleged that she had kidnapped a tribal woman but the very tribal woman told the magistrate in the court that she was never kidnapped by Shamim, yet her bail application was rejected and sent to jail. She was arrested within 24 hours following a 48-hour ultimatum by the industries association demanding her arrest. Shamim has been involved in the struggle of the saw mill workers and the hammals (kulies) who have been denied the minimal legal entitlements. She was fighting against the nexus between politicians and forest mafia.
“Shamim has been active in Harda district of Madhya Pradesh over a decade for the cause of tribals and saw mill workers. She has voiced against corruption and exploitation of the workers of the saw mills (mostly owned by Gujarati industrialists). She has fought for the rights of the poor. But since she tried to take on politicians and industrialists, she has been victimized by the local police,” said renowned political analyst and commentator Yogendra Yadav in a press conference in New Delhi yesterday (26 February 2009).

Ever since Shamim fought assembly election against ex-revenue minster in 2003 she is being victimized by police. Just after results were announced she was arrested and released after 3 days. Now again after the assembly election, social worker and lawyer Shamim Modi, who is also president of Madhya Pradesh unit of Samajwadi Jan Parishad, was arrested by Harda police on 10th February and remanded to 14 days judicial custody by Harda CJM court. She was arrested after Harda industries association a day earlier gave a 48 hours ultimatum to district administration demanding that Shamim Modi and her husband Anurag Modi be arrested else they will close all their establishment.

For the last few months Shamim was instrumental in organizing laborers belonging to 60 saw mills and plywood factories in Harda y after organizing hammals working at various Krishi Upaj Mandi and ware houses.

“The four cases in which Shamim has been arrested are two years old and politically motivated. In last two years police even never bothered investigate the matter and having no intention either,” says a statement from Samajwadi Jan Parishad.

Addressing the press conference senior Supreme Court lawyer Prashant Bhushan said Shamim’s case indicates the country is heading towards becoming a police state. While the police has filed charge sheet in the case, it has not conducted any probe into the case, he said adding that hers was not a fit case for denial of bail as the victim of her alleged kidnapping act had told the court that she was never kidnapped.

Expressing his grave concern over the rising lawlessness of law enforcers, Prashant Bhushan said: We are living in a police state and it’s time to wake up and speak against police atrocities. Otherwise, we will slip into a totalitarian police state.”

Shamim Modi has done her master degree from Lady Shriram College, University of Delhi, M. Phil. from TISS Mumbai and L.L.B. from Bhopal University. As the vice president of Samajwadi Jan Parishad in Madhya Pradesh, she has contested two assembly elections and a Lok Sabha election. She has filed a number of cases of tribal and labour rights at the MP High Court. She was a member of the Tribal Subgroup of the Planning Commission of India that was involved in preparing the 11th Five Year Plan. She has been a trustee with renowned social worker late Baba Amte and Medha Patkar in the Jan Sahyog Trust.

गौरतलब है कि 10 फरवरी को सामाजिक कार्यकर्ता शमीम मोदी को दो साल पुराने एक मामले में हरदा पुलिस ने गिरफ्तार किया था। जन संगठनों ने शुक्रवार को फूलवती नाम की उस आदिवासी महिला को भी पत्रकारों के सामने प्रस्तुत किया जिसके अपहरण का आरोप भी शमीम मोदी पर है। समाजवादी जनपरिषद के राष्ट्रीय अध्यक्ष सुनील का कहना है कि शमीम मोदी एक ऐसी महिला कार्यकर्ता है जिन्होंने हरदा में मजदूरों, हम्मालों, आदिवासियों और दलितों के हितों के लिए संघर्ष किया है। इसी संघर्ष से नाराज प्रशासन और नेताओं ने साजिश रचकर उन्हें जेल पहुंचा दिया।

सुनील बताते हैं कि हरदा जिले की आरा मिलों में काम करने वाले मजदूर को न्यूनतम मजदूरी के भुगतान, काम के घंटों का निर्धारण, दुर्घटना का मुआवजा, भविष्य निधि का प्रावधान आदि सुविधाएं दिए जाने के लिए चलाए जा रहे आंदोलन का शमीम मोदी नेतृत्व कर रहीं थी। उद्योगपति और व्यापारी इस आंदोलन को हर कीमत पर तोड़ना चाहते थे और उन्हीं के इशारे पर प्रशासन ने शमीम मोदी पर संगीन धाराएं लगाकर जेल भेज दिया। शमीम मोदी को दो साल पहले हरदा जिले के ढेंगा गांव में हुई एक घटना में आरोपी बनाया गया है।

जन संगठनों के कार्यकर्ताओं का आरोप है कि मोदी पर फूलवती के अपहरण का भी मामला दर्ज किया गया है। पत्रकारों को फूलवती ने बताया कि शमीम ने तो उनकी मदद ही की थी क्योंकि एक वन अधिकारी ने गांव में आकर उत्पात मचाया था। प्रशासन ने उस वन अधिकारी के खिलाफ कार्रवाई करने के बजाए मोदी को ही आरोपी बना दिया है।

Ex-TISSIAN Activist Working for Rights of Tribal People Arrested 

Ms Shamim (nee Meghani) Modi ex-TISSIAN, law graduate, has had to pay a heavy price for taking up the cause of tribal people and other industrial workers, exposing the corrupt nexus between the politician and the mining mafia and for working towards bringing about a change in the political functioning. She was arrested in gross violation of democratic rights on 10th February 2009 from her residence at Harda, M.P. and is presently lodged in Hoshaganbad jail. Procedure to secure bail from M.P High Court is now. 

The arrest was made on false charges of instigating tribals to attack forest officials and another case of kidnapping with the intention to kill the same tribal people, leveled against her (and her husband) in 2007. Subsequently no enquiries were conducted. But the immediate cause of her arrest is that on 9th February local industrialists belonging to 60 saw mills and factories issued an ultimatum to local administration that Shamim Modi and Anurag Modi be arrested in 48 hours or else they would shut down their establishments since they felt harassed by the growing complaints raised by their employees. The Shramik Adivasi Sanghathana (SAS), the local community based organisation was instrumental in raising the issue of non-implementation of Labour Act in 60 saw mills and plywood factory of the town. She had also taken up the concerns of more than 1000 load workers working in various Krishi Upaj Mandi in Harda District. 

There is a need to protest this and bring the issue in the public domain.

Details of the case: 
For the past 2 years or more, Shamim's life has been under threat and she was given state protection during a P.I.L. which had crucial implications for illegal quarrying in the forest land of Betul District. The current charges and the circumstances of the arrest point towards the bias of the local administration against Ms Modi, Mr. Modi and the SAS. SAS has faced a lot of harassment from the local administration for taking up various issues of the tribal people like, non-payment of wages by the forest and other officials, bonded labour, alleged contentions to the title of land, inclusion of names of the tribal persons in the below-poverty-line list, etc. 

Given the nature of constant and difficult dealings with the administration to make their ends meet, the SAS over the past 6 years took a decision to become politically active in the hope of instilling democratic practices in the region. They are members of Samajwadi Jan Parishad, floated by peoples's movement striving to change the political system. They have been contesting the local, assembly and even Lok Sabha elections. The growing impact of the SAS activities and the fight for democratic space is being met by resistance from the local political and other power structures. 

Ms Shamim and her husband, Mr Anurag are educated/professionally qualified persons who have taken up the unpleasant task of working towards the rights of others (the tribal people and the marginalized) by sacrificing their careers and middle class security. Shamim has a B. A. from Jesus and Merry College, Delhi; M.A. from LSR, Delhi, M. Phil from TISS and Law Degree from Barkatullah University, Bhopal. The values adopted for work are Gandhian and socialist and it is to improve the ill-functioning systems of our society so that the marginalized have access to basic needs like food, shelter, health and education and can live in dignity under the law of the land. 

The Current Charges: 
The charges under which Shamim Modi has been arrested are clearly trumped up in character. This is in spite of the use of democratic and constitutional means by the Modis and the SAS to secure tribal and other sections of society their rights. 

The charges relate to an old case of 11th July, 2007, when forest department officials assaulted a tribal Ramdas and his sister-in-law Phoolwati in village Dhega for allegedly cultivating forest land. The official was armed and the people of the village in self defense overpowered him; subsequently the SAS activist and Shamim tried to lodge an F.I.R. which the police did not register. On the contrary, a case of kidnapping (Sec. 364 IPC) of the ranger (O.P. Patel), and robbery with intent to kill (Sec. 397 IPC), etc. were filed against Shamim and Anurag Modi, who were never even present at the site of the incident in village Dhega. Consequently, on 13th July 2007, Shamim along with Phoolwati and other women on proceeding to file the complaint at Harda District Court were stopped from doing so. They were then dragged away forcibly and taken to Bhopal for treatment. Ironically another case of kidnapping with intention to kill were lodged against Shamim. However the women were not given treatment at Bhopal. Due to a P.I.L. lodged it was possible to have a hearing in the High Court of M.P. at Jabalpur, where the women were heard and medical treatment arranged. 

Therefore, I seek solidarity from concerned citizens and citizens groups, and hope that this statement would be endorsed by you. It will be forward it to the C.M. of M.P., Chairperson of National Human Rights Commission, Chief Justice of M.P. and Prime Minister of our country.

मोर्चा की ओर से जारी एक बयान में कहा गया है, "गत 10 फरवरी को शमीम मोदी को झूठे प्रकरणों के आधार पर गिरफ्तार कर जेल भेज दिया गया था। प्रशासन द्वारा यह कार्रवाई हरदा के चंद व्यवसायियों के इशारे पर की गई। मोदी गरीब हम्मालों के संगठन के माध्यम से उनके अधिकारों की लड़ाई लड़ रही हैं जिस कारण इन व्यवसायियों के निहित स्वार्थो पर चोट पहुंच रही है। मोदी की गिरफ्तारी से प्रशासन व सरकार का गरीब विरोधी चरित्र उजागर होता है।"

Feb. 25: Is Madhya Pradesh going the Chhattisgarh way? The arrest of Shamim Modi, vice-president of the Samajwadi Jan Parishad in Harda in Madhya Pradesh, on February 10 and the refusal of the Harda district magistrate court to grant her bail has left activists convinced that her case could well end up being a repeat of Dr Binayak Sen’s case.

Dr Sen has been in lock-up for over 18 months. Shamim, a member of the tribal sub-group, had worked in preparing the 11th Five-Year Plan document and was also a trustee of Baba Amte’s organisation and of the Jan Sahyog Trust set up by Ms Medha Patkar. Having spent more than a decade fighting cases on behalf of tribals, her organisation had filed a PIL in the MP high court highlighting the nexus between the mining and the forest mafia. Agreeing that Shamim faced a threat to her life, the court had ordered that she be given two armed guards during the pendency of her writ petition.

The high court had also ordered compensation to three tribals on July 17, 2008 who had been handcuffed and paraded through the town, a case that had been fought by Shamim. She, along with her co-activist husband Anurag Modi, was also trying to ensure that the state labour laws were being implemented across 60 sawmills and plywood factories. They were also working with the "hammals" working at Krishi Upajmandi and railway warehouses. This had brought her in confrontation with local industrialists. Local activists allege that her arrest was precipitated following Harda Industries Association issuing a 48-hour ultimatum to the district administration that she be arrested.

हरदा। समाजवादी जन परिषद के कार्यकर्ताओं और आरा मिल मजदूरों ने संगठन की प्रदेश उपाध्यक्ष शमीम मोदी की गिरफ्तारी के विरोध में बुधवार शाम को जंजीर बांधकर विरोध-प्रदर्शन किया। इस दौरान हाथ में लोहे की जंजीर बांधे श्रमिकों ने प्रशासन के खिलाफ नारेबाजी भी की। आरा मिल मजदूरों की मांगों और शमीम की गिरफ्तारी के विरोध में नारायण टॉकीज चौक पर जारी श्रमिकों का धरना बुधवार को छठे दिन भी जारी रहा।

इस दौरान सजप के गोपाल राठी ने कहा कि कार्यकर्ता और मजदूर न्यायपूर्ण व्यवस्था के लिए संघर्ष कर रहे हैं। उनकी मांगों की अनदेखी कर प्रशासन पूंजीपतियों के इशारे पर काम कर रहा है। जिले में श्रम कानून का पालन नहीं हो रहा है। उन्होंने कहा कि सजप प्रदेश उपाध्यक्ष शमीम को दो साल पुराने फर्जी प्रकरण में गिरफ्तार किया है। यह कार्रवाई पूंजीपतियों के प्रभाव में आकर की गई है। राठी ने कहा कि सजप गांधी, लोहिया, आंबेडकर के विचारों में आस्था रखने वाला दल है।

संगठन के कार्यकर्ता अहिंसात्मक सत्याग्रह में विश्वास रखते हैं। हम सत्याग्रह के जरिए सरकार को अपनी मांगे मानने के लिए मजबूर करेंगे। इस दौरान चौराहे पर सजप कार्यकर्ता और मजदूरों ने हाथों में जंजीर बांधकर विरोध प्रदर्शन किया।

जंजीर हमारी टूटेगी-नेता हमारी छूटेगी के नारे लगाते मजदूरों ने कहा कि उनका अनिश्चितकालीन आंदोलन जारी रहेगा। धरने में बुधवार को श्रीराम, कन्हैयालाल मिस्त्री, आत्माराम, कैलाश, आनंद, मेहबूब खां, कमलेश, शहीद, तुलसी, मुकेश, रज्ााक खां, रामेश्वर सहित आरा मिल संगठन हरदा के अलावा खिरकिया के मजदूरों एवं सजप कार्यकर्ता शामिल हुए।

हरदा। प्रदेश सरकार पूरी तरह से पूंजीपतियों की दलाल और मजदूर एवं गरीब विरोध बन चुकी है। पूंजीपतियों के 48 घंटे के अल्टीमेटम पर सजप की प्रदेश उपाध्यक्ष शमीम मोदी को गिरफ्तार कर लिया गया, जबकि हम्मालों, मजदूरों की जायज मांगों पर महीनों तक कोई सुनवाई नहीं होती। इससे पता चलता है कि सरकार द्वारा सत्याग्रह करने और गरीबों की आवाज उठाने वालों पर झूठे प्रकरण दर्ज कर उन्हें जेल में डाला जा रहा है। यहे बातें सजप के राष्ट्रीय अध्यक्ष सुनील ने यहां पत्रकारों से चर्चा के दौरान कहीं।सजप के स्थानीय कार्यालय में मंगलवार को आयोजित पत्रकार वार्ता में सजप के राष्ट्रीय अध्यक्ष सुनील ने कहा कि राज्य सरकार शमीम पर झूठे केस दर्ज कर उसे जेल भेजकर मजदूरों और श्रमिकों की आवाज को दबाने का प्रयास कर रही है। उन्होंने कहा कि शमीम पर एक मामले में अपहरण, जानलेवा हमला, जान से मारने की धमकी देने सहित करीब 11 धाराओं में प्रकरण दर्ज किया गया है, जिसे देखकर ऎसा लगता है कि प्रशासन उन्हे खूंखार अपराधी के तौर पर प्रदर्शित करना चाहता है। 20 को होगा प्रदर्शनसजप की प्रदेश उपाध्यक्ष शमीम मोदी की गिरफ्तारी के विरोध में 20 फरवरी को भोपाल एवं जबलपुर में प्रदर्शन किया जाएगा। भोपाल में होने वाले प्रदर्शन में हरदा जिले के अलावा होशंगाबाद, बैतूल एवं खंडवा जिले के मजदूर, आदिवासी महिला और पुरूष एवं सजप कार्यकर्ता शामिल होंगे। सीएम को लिखे जाएंगे एक हजार पोस्टकार्डशमीम मोदी की गिरफ्तारी के विरोध में पोस्टकार्ड अभियान शुरू की गया है। इसके तहत जिले के मजदूर, आदिवासी महिला और पुरूष प्रदेश के मुख्यमंत्री शिवराजसिंह चौहान को एक हजार पोस्टकार्ड लिखेंगे। मजदूरों के हितों का ध्यान रखे प्रशासनहरदा। सजप के राष्ट्रीय अध्यक्ष सुनील ने कहा कि प्रशासन और राज्य सरकार को मजदूरों के हितों का ध्यान रखना चाहिए। अघिकारियों को जनता के अघिकारों की रक्षा करनी चाहिए, जबकि जिला प्रशासन पूंजीपतियों के इशारों पर काम कर रहा है। सुनील मंगलवार शाम को नारायण टॉकीज चौक पर आयोजित नुक्कड सभा को संबोघित कर रहे थे। मालूम हो कि मजदूर संगठन की प्रदेश उपाध्यक्ष शमीम मोदी की गिरफ्तारी और अपनी मांगों को लेकर अनिश्चितकालीन धरने पर बैठे हैं। धरने में शामिल हुए सुनील ने कहा कि गरीब आदिवासियों और मजदूरों की आवाज उठाने का खामियाजा शमीम को भुगतना पड रहा है। उन्होंने कहा कि मजदूरों को उनकी निर्घारित मजदूरी और उनके अघिकारों के लिए लडना अन्याय नहीं है। जिले के आरा मिल मालिक श्रमिकों का शोषण कर रहे हैं। उन्हें निर्घारित मजदूरी से कम पैसा दिया जाता है। धरने में मंगलवार को आरा मिल श्रमिक शामिल थे।

A prominent activist, Shamim Modi, was arrested in Madhya Pradesh on alleged charges of kidnapping, setting a glaring example of atrocities against those who fight for the rights of the poor, tribals and Dalits.

The tribals from Betul and Harda are demanding the release of Modi.

The Madhya Pradesh government, acting under pressure from local goons and officials, accused Modi of anti-national activities and the court also denied him bail.

"In the case that was put up before the session judge, nowhere is it mentioned that she indulges in anti-state activities. But her bail was rejected by the judge on that very ground. This is very serious and a dangerous sign," said Raghvendra Patel, advocate, Jabalpur High Court.

Modi has been running the Shramik Aadivasi Sangathan for 18 years. The organisation fights for tribals' rights to land, water and forest.

In 2007, forest officials started forcibly evicting tribals. This escalated into violence. When Modi's organisation went to file a case, they faced police brutality.

Four tribals were illegally detained and Shamim was charged with kidnapping them.

In the list of those kidnapped was Phoolwati, a social worker and member of Shramik Aadivasi Sangathan.

"They have accused her of kidnapping me. She is innocent and was doing a good job. They have thrown her in jail," she said.

Social workers said that over the last two years, Shamim was successful in mobilising tribal and Dalit workers who form the main labour force in local factories.

The industrial association, which felt threatened, then forced the government to resurrect the two-year-old kidnapping case and arrest Shamim.

The arrest seems to be an act of retaliation against Shamim Modi for helping the weakest to fight for their rights. It is also an attempt perhaps to silence the voice. But the trend of branding social activist as anti-state people, sometime also as Naxalities, may have dangerous consequences.




Threat to Life of Activist Shamim

Dear friends, ever since Senior Activist Shamim Modi of SHRAMIK ADIVASI SANGATHAN and SAMAJWADI JAN PARISHAD (Betul and Harda) exposed the corrupt nexus of mining Mafia and Politicians operating in the reserved forests of Harda and Betul District the politicians namely Revenue Minister Kamal Patel also MLA from Harda , an M.P. of BJP from Betul mr. Vijay Kumar Khandelawal, Minister In charge of the Harda district Smt. Kusum Mehendale, National Executive Member of BJP Raja Thakur and Ex-president of Harda Municipal Corporation Surendra Jain are after their life. They are so powerful that the District collector of Betul Sanjeev Jha was trransferred within 24 hrs of his taking action against the Mining Mafia.

On behalf of SHRAMIK ADIVASI SANGATHAN, Shamom Modi filed a PIL in the High Court at Jabalpur demanding actions against the illegal mining activities in the reserve forests. On three occasions, the High Court ordered and got the matter enquired through the Registrar (Vigilance) of High Court and found that the illegal mining operations were actually going on in a big way in the reserve forests of Betul and Harda districts under the protection of the above Nexus. The High Court has ordered stoppage of all illegal mining activities in the two districts.

Considering the threat to her life, the High court at Jabalpur, in the above ongoing PIL regarding illegal Mining, provided Shamim Modi with 2 Armed Guards. But Even then on one or other occasions, false and frivolous cases are filed against her and on many occasions her guards were made to make false complaints against her.

On 13th Feb 2007 the administration got an FIR registered against under SC ST Atrocities Act against Anurag Modi, a Senior Activist of the Organisation, under Sec. 506, 294 and 3 (1) (X) of SC ST Act at Harda SC ST Police station by none other than the guards of shamim Modi. The FIR said that Anurag Modi has abused the Dalit Guard on caste-line and threatened to kill him with his own Rifle.

The action of the Administration shows that tommorrow Shamim Modi be another one who may be killed by her own guards in order to get rid of her. Feeling the constant threat, presently she has returned her guards and has filed an Interlocutory Application before the High Court at Jabalpur for withdrawal of Security Guards.

भोपाल. समाजवादी जनपरिषद की नेता शमीम मोदी की हरदा में गिरफ्तारी के विरोध में करीब आधा दर्जन जनसंगठनों ने जंजीर बांधकर रैली निकाली और लिली टॉकीज चौराहे पर घेरा बनाया। इसके बाद इन लोगों ने गृह मंत्री जगदीश देवड़ा, श्रम राज्य मंत्री करण सिंह वर्मा और अतिरिक्त पुलिस महानिदेशक सुरेंद्र सिंह से मुलाकात कर ज्ञापन सौंपा।

समाजवादी जन परिषद, किसान आदिवासी संगठन, जागृत आदिवासी दलित संगठन, श्रमिक आदिवासी संगठन, भोपाल गैस पीड़ित महिला उद्योग संगठन और नर्मदा बचाओ संगठन द्वारा यादगारे शाहजहानी पार्क से रैली निकाली। इसमें प्रदर्शनकारी एक-दूसरे को जंजीरें बांधकर चल रहे थे। लिली टॉकीज चौराहा पर पहुंचकर इन लोगों ने बंधी हुई जंजीरों के साथ घेरा बनाया। रैली यहां सभा में परिवर्तित हो गई।

जनपरिषद के राष्ट्रीय अध्यक्ष सुनील व अन्य नेताओं ने पत्रकारों से चर्चा में आरोप लगाया कि शमीम मोदी को इसलिए गिरफ्तार किया गया, क्योंकि वे लंबे समय से हरदा जिले में मजदूरों, हम्मालों, आदिवासियों और दलितों के हित में संघर्ष कर रही हैं। 9 फरवरी को हरदा के उद्योगपतियों और व्यापारियों ने जिला प्रशासन को अल्टीमेटम दिया था कि 48 घंटे के भीतर शमीम मोदी को गिरफ्तार किया जाए और 24 घंटे के भीतर उन्हें गिरफ्तार कर लिया। माकपा के राज्य सचिव बादल सरोज ने शमीम मोदी की गिरफ्तारी की निंदा की है। उन्होंने शमीम मोदी के खिलाफ दर्ज मामले वापस लेने और उन्हें रिहा करने की मांग की है।

Bhopal: In a case of somewhat suspect efficiency, the Madhya Pradesh Police arrested a social activist from Harda within 24 hours of an ultimatum given by associations of local industrialists and traders. A host of NGOs and activists have taken to the streets in Harda and Bhopal in protest ever since the February 10 arrest of the activist, Samajwadi Jan Parishad (SJP) leader Shamim Modi.

Since the trade and industrialists' associations had no direct cases against Modi, who has been sent to judicial custody until February 24, the police arrested her in connection with some offences she allegedly committed two years ago.

The 42-year-old Modi has an MPhil from the Tata Institute of Social Sciences (TISS) and is also a law graduate and is known for fighting for the rights of tribals and other disadvantaged classes of the society in southern Madhya Pradesh.

Harda Industries Association and Vyapari Sangh had on February 9 given a 48-hour ultimatum saying if the Harda administration failed to act against Modi and her husband Anurag, a civil engineer, they would lock the doors of saw mills and other factories in the area. The administration was warned that closure would lead to job losses and a possible law and order problem.

“The arrest was made under pressure from the local industrialists who were worried that they will have to pay more wages and follow labour laws,” SJP national president Suneel alleged.

However, Harda SP K P Venkateshwar Rao said she was faced several cases for instigating tribals against the state and she was arrested “because investigation was complete on that day.” “The arrest has nothing to do with the ultimatum. The investigation in offences against her was going on for a long time,” said additional SP Prembabu Sharma.

Recent- She is denied with her lawyer at Harda Jail, not allowed to write letter to CJ of MP high court and human rights commission. At MP HC process such that the bail application will be heared by serial no which wl come after 3 weeks from now. The Madhya Pradesh 

 Government will oppose the bail application tooth and nail they want to keep Shamim for longer time. pl write to CM condemning his action at  at this site he invites idea for betterment of the state. This site should be flodded with idea and question . Also write to CJ MP High Court quoting PIL no saying how can raising public cause through PIL can be harassed like this. Release Shamim Modi: CPI(ML)

Bhopal, Feb 18:  The Madhya Pradesh state unit of the Communist Party of India (Marxist-Leninist) has severely criticised the state government for arresting the Samajwadi Jan Parishad Madhya Pradesh state vice president Shamim Modi and demanded her immediate release.

In a press note released here on Wednesday member of state council of the CPI (ML) said that the state government acted under pressure from local goons, traders and officials and accused him of anti-national activities and the court denied him even bail. This is anti-democratic, he said.

CPI(ML) state secretary Babulal Yadav said that such anti-democratic activities against those who fight for the rights of poor, tribals, and dalits are shameful. He said that the people should unite to fight against the fascist forces to save democracy. 
He said that his party demand immediate release of Shamim Modi without delay.


Democratic Socialist Leader Shamim Imprisoned Without Bail

The administration seems to harrass and oppress anyone who questions its actions or policies. The case of Shamim Modi is another example of such an attitude.

Ever since
Shamim Modi fought assemble election against ex revenue minster in 2003 she is being victimized by police. Just after results were announced she was arrested and released after 3 days. Now again after the assembly election A state vie president of Samajwadi Jan Parishad (SJP) and a social worker and lawyer Shamim Modi is arrested by Harda police on 10th February and remanded to 14 days judicial custody by Harda CJM court.

She was arrested after Harda industries association a day earlier gave a 48 hours ultimatum to district administration demanding that Shamim Modi and Anurag Modi be arrested else they will close all their establishment. For last few months Shamim was instrumental in organizing labour belonging to 60 saw mills & plywood factory after organizing Hammals working at various Krishi Upajmandi and ware house, railway mal godam in the Harda district. The 4 cases in which Shamim is arrested are 2 years old and politically motivated. In last two years police even never bothered investigate the matter and having no intention either.

Larger Conspiracy-The industrialist’s ultimatum was part of larger conspiracy by ruling BJP to check the growing popularity of SJP and also teach lesson to the social and political activist in the state. Now Shamim Modi’s case seems to be heading Vinayk Sen’s way it is evident from the developments so far. On 12th February denying the bail application District & session judge, Harda J.P. Parashar said "Uchha Siksha aur vidhi ka gyan rakhne wali si mahila jo rajya virodhi karya karne ka apradh karti hai use jamanat ka labh diya jana nya sangat nahi hai." (A well educated lady having legal knowledge, involved in anti state activities can not be granted bail). The judge’s remark is clear indication that Shivrajsingh Government is planning to keep Shamim Modi in jail for a longer time. The comment will also be used against Shamim and Anurag Modi (Her husband and co accused) in externment proceeding pending at DM’s court Harda.

But at the one hand judge wrote this remark at the same time he has written that "She files PIL against forest officials, educate tribals about their rights, work for their welfare through her organisation". He has sited this as if this is also a crime.

Fact of the case- The above mentioned remark by the judge was uncalled for and does not bear any legal ground. The allegation, as mentioned in bail order and also in the FIR, in the case criminal case no 76// 07 reads that on her and her husband Anurag Modi’s instigation tribals of village Dhega in Harda district attacked forest ranger O.P. Patel and others and kidnapped them on 11th July 2007 when they were taking arrested tribal Ramdas with them. According to an FIR Shamim and Anurag were not present at the incident site. The prosecution says the inflammatory speech by the Modi couple has caused the incident. No where it talks of anti state activities.

The reality of the story can be understand by the fact that where as on 12th July 07 Shamim and Anurag were accused of instigating tribals to kidnap forest officials and on 13th July Shamim was accused of kidnapping two of these tribals. The story is like this- On 11th July 07 the forest Ranger O.P. Patel along with 30-40 personnel reached village Dhega and finding Ramdas in the field cultivating forest land started firing indiscriminately and beaten Ramdas and Foolwati with back of the rifle and broken their jaw and arms. Villager hearing the noise came to the seen and overpowered the ranger. The villagers informed the Superintendent of Police through nearest telephone booth. After getting the message Shamim also informed the SP on the same night. Next morning on 12thpolice went to the villagers handed the ranger to them.

The injured tribals of village Dhega were also brought to Harda by police. The police registered the case against tribals and Shamim and Anurag the case no 76/07 of Rahatgaon PS u/s 341, 364 294,237,323,355,186,506,34 of IPC but refused to lodge to lodge their FIR. On 13th morning Shamim along with two tribal women Foolwati and Munni left the hospital for Harda district court, just opposite the district court police dragged them on the street and took away tribal women so they could not reach the court to lodge the complaint case. Thereafter police registered a case no 47/07 against Shamim u/s 341, 353,364,34 of IPC, of kidnapping tribal with the intention to kill. After Shamim moved the High Court the kidnapped tribals were released from police custody in Bhopal Hospital and given treatment at Jabalpur.

Short Background- Shramik Adiwasi Sanghthan and Samajwadi Jan Parishadhas been instrumental in exposing corruppt nexus of politician and bureucart. Shamimhas also filed PIL 4644 at jabalpur HC regarding attrocities against tribals and nexus of mining and forest mkafia close to rulling BJP in the state. Considering threat to her life and liberty HC gave stay on her arrest and provided her with two armed guards during pendcy of the writ petition. The HC passed an order on 17th July 2008 awarding compensation to three tribals who were handcuffed, tribals should not be removed from forest land till verification process is over as per new trible right act and action against all involve in illegal mining. No action so far Shamimhas to file cotempt pettion.

Profile- Shamim was member of tribal subgroup in preparing a 11th five year plan, trustee with renowned social worker late Baba Amte and Medha Patkar in Jan Sahyog Trust. She has done her M.A. degree from Lady Shriram College Delhi and M.Phil from TISS Mumbai. L.L.B. from Bhopal University. SJP’s MP vice president, fought two assembly elections against ex Revenue minister of MP, a parliament election. Fight cases of tribals and labour at MP HC.

Protest- In protest of Shamim’s arrest all the labour union belonging to Harda, Khirkiya, Timarni, Sirali and Rhatgaon Krishi Upaj Mandi in Harda district, Railway Mal Godam union, ware house union, saw mill union belonging to 60 saw mill in the Harda city are went on the day’s strike on 12th February and took out a big rally at Harda. .From 13th the saw mill union has went on indefinite strike and started a sit in at Harda demanding implementation of labour lawsand opposing Shamim’s arrest.

Expectation – Write protest letter to CM, MP, Human rights commission seeking their intervention in earlier release of Shamim and implementation of labour laws in Harda.
